Darnell T. Valentine In Prison For Life!He Had Been Caught Carrying Illegal Firearms In The Past!
He Set Up
Benjamen Hugo Dice To Assault & Rob Him & When He Ran To Avoid Harm Shot Him In The Back Multiple Times!This is allegedly what happened!
Darnell made arrangements on his cell phone to meet
Benjamen Hugo Dice (an alcoholic & drug addict) at a vacant apartment building located at 229 Victor Ave. Dayton, Ohio at approximately 6:40 P.M. on June 19, 2006 to sell him $750.00 worth of a drug called ecstasy.Darnell cruelly & sadistically shot Benji in the back multiple times for no valid reason at all & certainly not for self defense.
Not In The Back!
Even though he was fatally shot to hell & back & bleed profusely
(his blood was all over hell) he somehow made it out the front door & collapsed on the front lawn.It was a morbid & gruesome scene to say the least.
Neighbors were horrified & so was everyone else that read about it in the newspaper or saw it on TV on the 6 o’clock news
(if it bleeds it leads).After the shooting two people were seen fleeing the scene of the crime.
They went out the back door & through a garage & down the alley behind the building.
One was Darnell & the other was his unidentified supplier.
The murder weapon was never located & has never been found & the other unidentified person probably has it in his possession & is still out there on the streets & could kill again.
Darnell copped a plea & bargained with prosecutors & the judge & then plead guilty to murder & aggravated burglary.
He also admitted to the judge on the record in a court of law that he had been engaging in illegal drug activities in the past but he never told police where the murder weapon was or who the other person that was with him was.
Darnell has never talked or cooperated with police.
As his first trial date approached he asked for a new public defender claiming the one he had been provided was inadequate counsel & the Judge granted him a new public defender for no valid reason at all at tax payer expense just so Darnell could delay his trial & that benefited only him & no one else.
The original trial date was postponed & a new trial date was set many months later.
After the trial began Darnell decided to bargain & cop a plea & we were consulted & agreed to go along with it to avoid the pain & misery of a long drawn out trial.
He plead guilty to murder & aggravated burglary.
A firearm specification was dropped & tampering with evidence was also dropped as a part of the plea bargain that would have automatically added 3 years to his sentence if he had been found guilty & convicted in a jury trial & that would have made his minimum prison time 18 years to life.
The Judge also said he would consider allowing him to serve the aggravated burglary charge concurrently as a part of the plea bargain agreement.
After Benji’s mother & I read our
statements at his final sentencing Darnell turned to face everyone in the court room only at the verbal prodding & insistence of his family & said in a very low weak & quick statement he was sorry to all the families but you could tell he really did not mean it because he just turned back around real quick & just fluffed it off to get it out of the way without a tear in his eye or sorrowful expression whatsoever & this is a guy that brutally murdered someone’s child in cold blood.If he was so sorry why did he not disclose the name of the other person that was with him when he killed Benji or tell police what really happened or disclose the location of the murder weapon?
Just to prove to us how really sorry he was he then told the Judge that he wanted to withdraw his guilty plea claiming he had inadequate counsel & had been given bad advice even though the second public defender he had been provided at tax payer expense was one of the best in the business & has an excellent track record to prove that.
This
lawyer got three years knocked off of his sentence through plea bargaining with the prosecutors & the Judge & Darnell was not the least bit appreciative of that fact.The Judge told him that he had previously gone over his rights with him thoroughly before he voluntarily chose to give up all of his rights by pleading guilty & it was all part of the court record & rejected that & then sentenced him to
15 years to life in prison on the murder charge which is really nothing more than a slap on the wrist for a crime like that & allowed him to serve the aggravated burglary charge concurrently which means he will be eligible to be released on parole on July 7, 2021.The Judge simply could not ad the aggravated burglary charge on to his sentence as I had requested in my statement because of mitigating circumstances beyond his control.
Darnell has not been charged or prosecuted for illegal drug trafficking & neither has his supplier which means he & his supplier is simply getting away with that without any penalty whatsoever.
Please Help Keep Darnell T. Valentine In Prison For Life.
